These Terms of Use are a binding agreement between you and ZenAuto, LLC. By accessing or using this website, you agree to these Terms and the documents incorporated by reference. If you do not agree, do not use the website.
1. Website purpose
This website provides general information about ZenAuto and vehicle service contracts, accepts applications for potential access, enrolls applicants for general availability notices, and provides communication tools. It does not itself issue a vehicle service contract or create coverage.
2. Eligibility to use the website
You must be at least 18 years old and able to enter a binding agreement. You may use the website only for lawful, personal purposes and only with information you are authorized to provide.
3. Applications and availability
Anyone may submit an application, but coverage is currently limited to approved customers. An application is a request for review. It is not an offer, acceptance, contract, approval, quote, reservation, or guarantee. ZenAuto may request additional information, decline an application, change availability, or discontinue an application program as permitted by law.
Every applicant is enrolled for general availability notices by email. You may unsubscribe from marketing or availability notices using the method in the message. Transactional or legally required communications may continue.
4. No product contract through website content
Descriptions, examples, FAQs, eligibility factors, and educational content are general and may not describe an option available to you. Coverage exists only under an issued written vehicle service contract after all required acceptance and payment steps. The written contract controls if website content differs from it.
5. Your submissions
You represent that information you submit is accurate, current, and yours to provide. Do not submit a VIN, Social Security number, driver license number, health information, payment card, bank account, password, or other sensitive data unless ZenAuto expressly requests it through an appropriate channel.
6. Electronic communications
Your use of forms is also governed by the Electronic Communications Consent. You are responsible for maintaining a current email address and equipment that can access electronic records.
7. Acceptable use
You may not interfere with website operation or security, bypass access controls, submit false or automated requests, introduce malicious code, scrape at a disruptive rate, impersonate another person, infringe rights, or use the website for unlawful or fraudulent activity. Ordinary search indexing and assistive technologies are permitted.
8. Intellectual property
The website, Open Road logo, text, graphics, design, and compilation are owned by or licensed to ZenAuto and protected by applicable law. Limited personal access does not transfer ownership. See the Trademark Notice.
9. Third-party resources
Links to government, educational, provider, administrator, or other third-party resources are provided for convenience. ZenAuto does not control those resources and is not responsible for their content, security, availability, or practices.
10. Disclaimer
To the maximum extent permitted by law, the website is provided “as is” and “as available.” ZenAuto does not warrant uninterrupted operation, freedom from error, or that general website information fits your circumstances. Nothing on the website is legal, tax, financial, insurance, mechanical, or repair advice.
11. Limitation of liability
To the maximum extent permitted by law, ZenAuto will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from website use. ZenAuto's aggregate liability for website-only claims will not exceed one hundred dollars. These limits do not apply where prohibited or to liability that cannot lawfully be limited.
12. Indemnity
To the extent permitted by law, you agree to defend and indemnify ZenAuto from third-party claims arising from your unlawful use of the website, your material breach of these Terms, or information you submit without authority. This does not require indemnity for ZenAuto's own unlawful conduct.
13. Governing law and disputes
Ohio law governs these Terms without regard to conflict-of-law rules. Unless applicable law requires otherwise, disputes concerning this website must be brought in a state or federal court with jurisdiction in Cuyahoga County, Ohio. Product disputes remain subject to the dispute terms in the applicable written vehicle service contract.
14. Changes and severability
ZenAuto may update these Terms by posting a revised effective date. Material changes apply prospectively unless law permits otherwise. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue.
